BlockBeats News, on October 24th, FOX reporter Eleanor Terrett posted on social media that Ripple will submit its Form C today, outlining the main points they will appeal in the second circuit court in the SEC lawsuit. Last week, the SEC appealed almost all of its issues lost in the district court, and Ripple is expected to appeal the only ruling it lost: that the sale of XRP by their organization constituted the sale of unregistered securities. Ripple's Chief Legal Officer Stuart Alderoty said, "I feel better about our case in the second circuit court, for many reasons. The second circuit court has never supported the SEC, nor has it supported excessive regulation. Statistically, if you lose in the district court, your chances of winning an appeal in the second circuit court are about 10% or less." Ripple CEO Brad Garlinghouse said, "I am very confident that we will win the appeal, which will completely break Gary Gensler's entire plan on encryption regulation."
